By accepting this agreement, the BUYER undertakes the obligation to make the payment for the subject order, including the order amount, shipping fee, and any additional charges specified, and acknowledges being informed in advance.
2. SUBJECT
This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of the product specified with its features and sales price, which the passenger ordered electronically through viptime.com.tr website, in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.
The listed prices on the website are the sales prices. The advertised prices and promises are valid until updated or changed. Prices advertised for a limited period are valid until the specified period ends.

4. SERVICE AND PAYMENT DETAILS
4.1 The contract amount, including VAT, is specified in the service details.
4.2 Under this agreement, I authorize Joydeep Travel Tourism Trade Co. Ltd. to collect payments for the transfer service I purchased or will purchase through my IYZICO account using my registered credit card. I also acknowledge that Joydeep Travel Tourism Trade Co. Ltd. is authorized to process the credit card transaction.
4.3 The invoicing period for the purchased service is 7 days from the purchase date, provided that it does not skip a month according to the Tax Procedure Law.

5. DETAILS OF THE SUBJECT SERVICE/SERVICES
5.1 The basic features of the service are published on Joydeep Travel Tourism Trade Co. Ltd.'s website. If the seller has organized a campaign for the relevant product, you can review the basic features of the product during the campaign period. The campaign is valid until the specified date.
5.2 The listed prices on the website are the sales prices. The advertised prices and promises are valid until updated or changed. Prices advertised for a limited period are valid until the specified period ends.
5.3 The total sales price, including all taxes, of the goods or services subject to the agreement is shown below.

6. GENERAL PROVISIONS
6.1 The User, by making payment for the transfer service through credit card, debit card, bank transfer, or electronic funds transfer (EFT), shall be deemed to have accepted the written terms and conditions of the service agreement. This acceptance does not imply the requirement for the contract to be signed in writing, but it is assumed that the user has read, understood, and accepted the terms of the contract since the payment has been made.
6.2 The Passenger must comply with all kinds of regulations, including the Road Traffic Law, and must adhere to all safety rules, such as wearing a seatbelt and complying with safety regulations, within the framework of the legislation.
6.3 The User must make a reservation at least 2 hours prior to the transfer time in order to benefit from the transfer service within the scope of this agreement. For special occasions such as religious and national holidays, New Year's Eve, and other official public holidays, the User is required to make a reservation at least 24 hours prior to the transfer time in order to be able to make a reservation. The User can cancel the reservation at least 24 hours prior to the transfer time and in this case, the service fee paid will be refunded. However, no service fee refund will be made for reservation cancellations made outside the specified timeframes.
6.4 The Passenger does not have the authority to change the route in all transportation services. Requests for the Passenger to deviate from the designated route and wait at a different location within the route are not accepted. In VIP transfer services, requests for different points outside the specified route(s) mentioned in the contract will be subject to separate charges for each different point.
6.5 The Passenger does not have the authority to change the route during the journey. When the Passenger wants to stop at a location outside the designated route or stay there for a while, the request is not accepted. In VIP transfer services, when the Passenger wants to stop at different points other than the routes specified in the contract, a separate fee will be charged for each different point.
6.6 Joydeep Travel Tourism Trade Co. Ltd. is obliged to allocate vehicles for the transfer service that are suitable for the number of passengers and luggage capacity specified by the Passenger at the time of purchasing the transfer service. Joydeep Travel Tourism Trade Co. Ltd. accepts and undertakes that all vehicles allocated for this service will have individual accident and seat insurance, periodic maintenance will be carried out within the specified intervals, and mandatory equipment such as spare tires, first aid kits, fire extinguishers, reflectors will be available. Joydeep Travel Tourism Trade Co. Ltd. shall not be held responsible for any physical or material damage suffered by the customer or damage to the transported goods due to any traffic accidents or any other reason during the transfer. In such a case, the Customer acknowledges and declares in advance that Joydeep Travel Tourism Trade Co. Ltd. shall not have any liability arising from Article 66 of the Turkish Code of Obligations and other provisions of the legislation, without recourse.
6.7 Except for the passenger and luggage information provided by the Passenger during the purchase stage being accepted by Joydeep Travel Tourism Trade Co. Ltd., passengers or luggage exceeding the limits accepted by Joydeep Travel Tourism Trade Co. Ltd. cannot be accommodated in the vehicle. In case the Passenger decides to renounce the transfer service for this reason, no refund will be made.
6.8 The customer who will perform the passenger transfer must prove with their identity documents issued by the competent authorities and the reservation document that they are the customer who has purchased the service. The transfer will not be made for the customer who fails to fulfill this obligation. However, if Joydeep Travel Tourism Trade Co. Ltd. is convinced that the credit card holder who made the reservation has consented to the Passenger receiving this service, the Passenger may benefit from this service.
6.9 Joydeep Travel Tourism Trade Co. Ltd. is not responsible for the loss or damage of any items forgotten by the customer inside the vehicle during the transfer. In such a case, the Passenger must contact Joydeep Travel Tourism Trade Co. Ltd.'s call center and retrieve the forgotten item from the address notified to them.
6.10 Joydeep Travel Tourism Trade Co. Ltd. does not accept sacks, crates, boxes, etc. as baggage in transfer vehicles. Each passenger is entitled to a maximum of 1 carry-on bag and 1 suitcase per person (Carry-on bag should not exceed 8 kg in weight, and the accompanying suitcase should not exceed 32 kg in weight). The Passenger acknowledges, undertakes, and declares that there are no prohibited substances as defined by the Turkish legislation, such as flammable, inflammable, explosive, narcotic, liquid, odorous, and radioactive materials, in the baggage subject to transfer. If the presence of the substances mentioned is noticed by the driver, the corresponding baggage will not be accepted into the vehicle. In addition, in such cases, the Passenger cannot claim any receivable or right against Joydeep Travel Tourism Trade Co. Ltd. under any name. In case the presence of the mentioned substances is noticed during the transfer, the situation will be immediately reported to the authorized official authorities by Joydeep Travel Tourism Trade Co. Ltd. If the presence of the mentioned substances is not noticed by the driver and is detected during the search and inspection of the vehicle during the transfer, any damage and loss suffered by Joydeep Travel Tourism Trade Co. Ltd. and/or any person as a result will be paid by the Passenger in cash and immediately.
6.11 In our transfer vehicles, transportation of pets is carried out for cats, dogs, and small singing birds in a secure cage that does not disturb other passengers, provided that prior information is given during the reservation. Cage dimensions should not exceed 23*40*55.
7. PASSENGER PROVISIONS
7.1 Transfers of children under the age of 18 will not be made without adult companions or without the permission of their parents.
7.2 Toll fees, bridge fees, and any road charges along the transfer route are the responsibility of the passenger.
7.3 For shared transfers, an estimated information regarding the date and time of service will be shared with the passenger via email or phone at least 12 hours before the transfer. In VIP transfers, the passenger will receive the service according to their preferred pick-up and drop-off time.
7.4 In transfers from a specific point to the airport, Joydeep Travel Tourism Trade Co. Ltd. declares and undertakes that the allocated vehicle for the transfer will be present at the designated point at the specified transfer time. The passenger will be notified via email and SMS before the designated transfer date and time. Except for any extraordinary circumstances, unforeseen events, force majeure, flood, hail, rain, traffic congestion, etc., a delay of up to 20 (twenty) minutes will be considered a reasonable delay. In transfer points such as residential sites and housing complexes, if the entry of the vehicle is prevented by the site security personnel, Joydeep Travel Tourism Trade Co. Ltd. will not be held responsible for exceeding the 20 (twenty) minutes delay. In such cases, if the 20-minute limit is exceeded and the passenger does not wait for the vehicle, no refund will be made. The passenger must be present at the designated point with their luggage at the transfer time. If the passenger fails to be present with their luggage at the designated time, Joydeep Travel Tourism Trade Co. Ltd. is obliged to wait for the passenger for 5 (five) minutes. After 5 (five) minutes, if the passenger fails to arrive at the designated point with their luggage, the vehicle is not obligated to wait any longer. The time notifications provided by Joydeep Travel Tourism Trade Co. Ltd.'s operations, call center, and drivers will be binding for both parties.
7.5 In case of a delay exceeding 2 (two) hours due to a delay or any other reason, Joydeep Travel Tourism Trade Co. Ltd. is not obligated to wait at the airport. For shared transfers, the transfer will be arranged by Joydeep Travel Tourism Trade Co. Ltd. based on suitable timing and vehicle availability. In VIP service, the service will be provided with an appropriate vehicle allocated by Joydeep Travel Tourism Trade Co. Ltd.
7.6 The estimated arrival time specified during VIP Transfer reservation may vary depending on traffic conditions, weather conditions, and other factors. Joydeep Travel Tourism Trade Co. Ltd. cannot be held responsible for any delays beyond the estimated arrival time.
7.7 At the transfer point, the driver of the vehicle is not obligated to accompany the passenger to their side, the vehicle, or their home and then leave the vehicle.
7.8 If the transfer of a passenger using a wheelchair is requested along with shared transfers, this must be specified by the passenger during the reservation. Otherwise, the passenger will be responsible for any delays and/or any damages arising or to arise due to reasons such as the passenger's inability to board the vehicle, and Joydeep Travel Tourism Trade Co. Ltd. will have no liability. Physically disabled passengers who are capable of meeting their personal needs can travel alone without companions. However, if the passenger is unable to meet their personal needs, they can be transferred with a companion. The necessary reservation and payment must be made for this companion as well.
7.9 When purchasing online tickets with a non-Turkish bank credit card, your bank may apply an additional transaction fee to your ticket price. For detailed information, the passenger needs to contact their bank.
8. RIGHT OF WITHDRAWAL
8.1 In the event that the specified periods in this agreement expire and/or the conditions are not fulfilled, the right of cancellation cannot be exercised and no refund will be provided by Joydeep Travel.
8.2 In case of cancellations made 1 day prior to the start of the reservation, the full amount you have paid will be refunded.
8.3 In case of cancellations made up to 12 hours before the start of the reservation, half of the amount you have paid will be refunded. Apart from this, no refund will be provided in case of cancellation.
8.4 If you have made your reservation through Joydeep Travel's official website, you also have the option to make changes or cancel your reservation using the Reservation Code and your identification information through online sales channels or the call center.
8.5 Joydeep Travel reserves the right to cancel the reservation and/or transfer due to unexpected events, force majeure, natural disasters, hail, flood, traffic accidents, and similar circumstances. In this case, if no fault can be attributed to Joydeep Travel, no refund will be provided.
8.6 In the event that the passenger fails to fulfill their obligations under this Agreement and/or if the reservation is canceled and/or the service is not received due to any fault or negligence, Joydeep Travel will not assume any responsibility. Therefore, apart from the collection of the service fee, Joydeep Travel reserves all its legal rights.
9. DEFAULT AND LEGAL CONSEQUENCES
If the passenger defaults on payment when making payments by credit card, the passenger acknowledges, declares, and undertakes that they will be liable for interest payments and responsible towards the issuing bank in accordance with the credit card agreement between the passenger and the bank. In this case, the relevant bank may resort to legal remedies; they may demand the incurred expenses and attorney fees from the passenger. In any case where the passenger defaults on their debt, the PASSENGER agrees, declares, and undertakes to compensate Joydeep Travel Turizm Ticaret Ltd. Şti. for any damage and loss incurred due to the delayed performance of the debt.
10. COMPETENT COURT
In the event of disputes arising from this agreement, complaints and objections shall be submitted to the consumer dispute resolution board or the consumer court located in the consumer's place of residence or where the consumer transaction took place, within the monetary limits specified in the relevant law. The information regarding the monetary limits is as follows:
Effective from 28/05/2014:
- In disputes with a value below 2,000.00 (two thousand) TL, the district consumer arbitration committees, as stipulated in Article 68 of the Law on Consumer Protection No. 6502, shall be applied.
- In disputes with a value below 3,000.00 (three thousand) TL, the provincial consumer arbitration committees shall be applied.
- In metropolitan cities, disputes with a value between 2,000.00 (two thousand) TL and 3,000.00 (three thousand) TL shall be referred to the provincial consumer arbitration committees.
This Agreement is made for commercial purposes.
11. EFFECTIVENESS
By making the payment for the order placed on the website, the passenger is deemed to have accepted all the terms of this agreement. Joydeep Travel Turizm Ticaret Ltd. Şti. is responsible for making the necessary software arrangements to ensure that this agreement is read and accepted by the passenger who purchases the service on the website before the order is completed.
